Captain of the UCSD swim teams in 1994 and 1995, a 16-time All-American and  two-time Academic All-American, Bernstein graduated from George Washington Law School in Washington, DC where she met her husband, Matt Bernstein (they were married in 1999).

After working as a prosecutor for the City of San Diego and with a local law firm, she and two partners that firm opened their own practice in March of 2001—Maas, Miyamoto & Bernstein which specializes in legal malpractice defense work, general business litigation and products liability actions

Bernstein and her husband, a native of Boston, and their dog, "Fenway," live in the Eastlake area of San Diego and are expecting their first child in February.
